Case summary
On March 22, 2013, EPA Region 6 issued an Administrive Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to Rickaway Energy Corp., for violations at four of its oil and gas leases located in Wilson County, Texas. The AO was issued in response to violations of Section 301 of the CWA identified during inspections on 09/11/12 and 11/27/12. The AO requires Rickaway Energy Corp. to eliminate the unauthorized discharges of produced wastewater to water of the U.S. Rickaway Energy is also required to report on what actions have been taken to achieve compliance and to submit to EPA any effluent monitoring reports the facility submitted to the Texas Railroad Commission(RRC) within the last 5 years as required by the RRC discharge permits No. 00786, No. 00821, and No. 00947. Rickaway Energy Corp. must respond to EPA Region 6 within 75 days of receiving the AO.
