Case summary
The City of Sunland Park is a Phase II Municipal Separate Storm Sewer System, or Small MS4. The city was required to submit a Notice of Intent (NOI) and a Storm Water Management Plan (SWMP) by the October 1, 2007,deadline. They failed to do so. Since the General Permit under which they would have received permit coverage expired June 30, 2012, they were unable to acquire coverage. A penalty enforcement action was issued and the City paid a penalty of $5000. The Agency issued an Adminitrative Order on Consent on January 31, 2013, ordering the City to submit an NOI and a SWMP which would serve as an application for an individual permit until the general permit is re-issued. They were given thirty (30) days from January 31, 2013, to submit the NOI and SWMP.
