Case summary
On December 18, 2012, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to McCann Resources, Inc., located in Osage County, Oklahoma. The AO was issued in response to violations of Section 301 of the CWA for the discharge of oil field brine and produced water to a water of the U.S. The AO requires McCann Resources, Inc. to: (1) cease all discharges of pollutants from the facility; (2) remove all brine from the flow path located in between the facility and the identified tributary of Mission Creek; and (3) remove all brine from the tributary of Mission Creek, which was discharged from the facility on or about November 13, 2012. McCann Resources, Inc., must respond to EPA Region 6 within 30 days of receiving this AO.
