Case summary

On November 19, 2012, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sectons 308 and 309 of the Clean water act (CWA) to Berexco, LLC, located in Osage County, Oklahoma. The AO was issued in response to violation of Section 301 of the CWA for an unauthorized discharge of oil field brine and produced wastewater to a water of the U.S. The AO requires Berexco, LLC to: 1) cease all discharges of pollutants from the facility; and 2) remove all brine from the flow path between the facility and a tributary of Cimarron Creek, which was discharged from the facility on or about October 16, 2012. Berexco, LLC, must respond to EPA Region 6 within thirty days (30) of receiving the AO.
