Case summary

On October 31, 2012, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to Linn Operating, Inc., located in Osage County, OK. The AO was issued in response to an unauthorized discharge of oil field brine and produced wastewater to a water of the U.S on or about October 3, 2012. The AO requires Linn Operating, Inc. to: 1) cease all discharges of pollutants from the facility; 2) remove all brine from the flow path between the facility and the tributary to Sycamore Creek; and 3) remove all brine from the tributary of Sycamore Creek. Linn Operating, Inc. must respond to EPA Region 6 within thirty (30) days of receiving this AO.
