Respondent, ENMR Telephone Cooperative, Inc., d/b/a ENMR-Plateau, owned or operated linear construction site located in Santa Fe, New Mexico. A stormwater compliance inspection was conducted by the New Mexico Environment Department on May 14, 2012,to determine compliance with the Stormwater Construction General Permit. This is a linear project to provide phone service to rural homes east of Santa Fe, NM. This operator had not obtained permit coverage. There had been at least four rain events of 0.25 inch or greater that would have caused a discharge of pollutants to waters of the U.S. An administrative order was issued to addressed this lack of permit coverage.
