Case summary
Respondent, Fishel Construction Company, owned or operated ENMR-Broadband Project, a linear construction site, located in Santa Fe, New Mexico. A Stormwater Compliance inspection was conducted May 14, 2012, by the New Mexico Environment Department to determine operator compliance with the Stormwater Construction General Permit (CGP). It was determined at the time that the Operator, The Fishel Construction Company,had not applied for permit coverage nor had it developed a Stormwater Pollution Prevention Plan (SWPPP). An administrative order was drafted to address this violation of the Clean Water Act. On December 20, 2012, a letter was received stating the telephone coorperative had received permit coverage. By August 10, 2012, N-Con and Plateau Telecommunications had received permits for the project.
