On September 26, 2013, EPA Regon 6 issued an Administrative Order (AO) under its authority pursuant to the Safe Drinking Water Act (SDWA) to Marion Smith (Respondent) doing business as the Cox Additon Water System in Lubbock, TX. The AO was issued in response to cviolations of the fluoride maximum contaminant level (MCL). The AO requires respondent to submit to EPA: 1) a detailed plan to meet the fluoride MCL; 2) a cost analysis of the proposed plan; and 3) a construction schedule. Respondent must submit a plan to EPA Region 6 within 120 days of the issuance date of the order.
