Case summary

On multiple dates between on or about July 2008 and August 2009, Respondent discharged, caused the discharge, directed the discharge, and/or agreed with other persons or business entities to discharge dredged material and/or discharge fill material, as defined by 40 C.F.R. § 232.2, from point sources, including heavy equipment, in, on and to approximately 13.22 acres of wetlands and 522 linear feet of tributaries within the subject property that are waters of the United States as that term is defined in 40 C.F.R. § 232.2. This work was associated with development of a residential subdivision and was done without authorization under a permit issued by the United States Army Corps of Engineers ( Corps ). Respondent shall pay to the United States a civil penalty in the amount of four thousand dollars($4,000.00) to settle the violations. Property located west of Fann-To-Market Road 356, five miles north of the intersection with State Highway 190 in Onalaska, Polk and Trinity Counties, Texas.
