EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 122.2 of the Clean Water Act to Triple M Salt Water Disposal; LP located at 1709 Industrial, in Kilgore, Greg County, Texas. The AO was issued in response to violations of Sections 308 and 309(a) of the Clean Water Act (?the Act?), 33 U.S.C. ?? 1318 and 1319(a). Oil field brine and produced wastewater, generated from oil production activities, had been recently discharged from the facility to ?waters of the United States,? as that term is defined by 40 C.F.R. ? 122.2. Based on these findings and pursuant to the authority of Section 309(a)(3) of the Act, 33 U.S.C. ? 1319(a)(3), EPA orders that Respondent cease immediately all discharges of pollutants from the facility; remove old tanks and repair tanks leaks and berms; remove all brine from old pits, around tanks, and the flow paths located in between the facility and the identified tributary, located at N32.376070, W94.888887, which were discharged from the facility on or about August 30, 2012.
