Unilateral Administrative Order Without Adjudication
Case summary
On August 28, 2012, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Sections 308 and 309 of the Clean Water Act (CWA) to Quantum Resources Management, LLC (Quantum), located in Jacksonville, Texas. The AO was issued in response to a violation of Section 301 of the CWA for an unauthorized discharge of brine and produced wastewater to a water of the U.S. The AO requires Quantum to (1) Cease all discharges of pollutants from the facility; (2) remove all brine from the flow path located in between the facility and Owl Creek; and (3) remove all brine from Owl Creek, located at Latitude 31� 55.752� North and Longitude 95� 24.660� West, which was discharged from the facility on or about August 16, 2012. Quantum must respond to EPA Region 6 within 30 days of receiving the AO.
