EPA v. AMAFCA (NMS000101)
Unilateral Administrative Order Without Adjudication
Case summary
AMAFCA is a co-permittee to the NPDES MS4 permit along with the City of Albuquerque, NMDOT, and the University of New Mexico. AMAFCA accepts stormwater discharges from the City. The EXPO New Mexico has discharged its stormwater to the City without permit coverage. AMAFCA has been ordered to cease accepting stormwater from the City if that stormwater has co-mingled with stormwater from the EXPO. AMAFCA was given 90 days from the effective date of the Order to submit a schedule of compliance. Because AMAFCA has no regulatory authority or enforcement authority, this AO was closed on February 5, 2013.
