Respondent, City of Grants owned or operated a wastewater treatment plant located in Grants, Cibola County, New Mexico. On August 15, 2011, the New Mexico Environment Department conducted an inspections and the facility was found to be in violation of Section 301 of the Clean Water Act. The violation alleged is for the unpermitted discharge of pollutants from the facility and into waters of the United States during five (5) rainfall events of one-half inch or greater which occurred during the period of September 2010 to September 2011. In addition, there were no Best Management Practices implemented.
