Case summary
The City of Sunland Park, New Mexico owned or operated a Phase II Municipal Separate Storm Sewer System (MS4) that is required to have a complete Storm Water Management Plan (SWMP) before submitting a Notice of Intent (NOI). Sunland Park failed to submit the required SWMP and NOI by the October 1, 2007, deadline. Even though EPA Region 6 has worked with the City to develop a complete SWMP, to date a complete document has not been submitted. A penalty order has been drafted and sent to the City. The penalty was paid and the CAFO sent for signature on January 31, 2013.
