EPA v. Infinite Ambitions, LLC (NMU001764)
Unilateral Administrative Order Without Adjudication
Case summary
A stormwater compliance inspection was conducted at the construction site of Vista Bonitas Subdivision on September 27, 2011, and was conducted by the New Mexico Environment Department (NMED). It was determined at that time that Infinite Ambitions, owner of the eleven and three quarters acre site, had not obtained permit coverage under the Stormwater Construction General Permit (CGP) and had not developed and implemented a Stormwater Pollution Prevention Plan (SWPPP). An administrative order was drafted by the EPA which ordered Infinite Ambitions to develop and implement a SWPPP within thirty (30) days of receipt of the Order and to obtain permit coverage in the same timeframe. Final Order was issued November 25, 2011.
