On November 25, 2011, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 1421 of the Safe Drinking Water Act to Performance Energy Resources, LLC, located in Barnsdall, Oklahoma. The AO was issued because the company is maintaining the fluid level in the wells near or above the fluid level of the base of underground sources of drinking water (USDWs), which could allow contaminants to move through the wells into the USDWs. The AO requires Performance Energy Resources, LLC to complete corrective action on the wells to prevent fluids from moving through the wells into ground water resources.
