Case summary
A stormwater compliance inspection was conducted June 30, 2011, at the SWBB, Inc., in Farmington, NM, by the New Mexico Environment Department. At the time of the inspection it was determined that the facility had had previous coverage under the Multi-Sector General Permit (MSGP) but had failed to reapply for coverage under the current MSGP. Each day of operation without NPDES permit coverage was a violation of Section 301 of the Clean Water Act. An administrative order was issued to address the violation and order the facility to submit a complete and Notice of Intent for permit coverage and submit to EPA Region 6 a Storm Water Pollution Prevention Plan which was tailored specifically to the site.
