Case summary
EPA Region 6 issued an Administrative Order, Cease and Desist Order, under our authority pursuant to the Clean Water Act (CWA)to Berexco, LLC located in Tulsa,OK. The Respondents oil field facility was a point source which discharged a pollutant to waters of the United States. The facility was inspected by the EPA on June 14, 2011. During the inspection, the EPA observed that a tank battery facility had discharged oil field brine and produced wastewater to a tributary of the Cimarron River. A Cease and Desist Administrative Order was issued to Berexco, LLC on June 28, 2011. The Administrative Order was issued in response to violations of Section 301 of the CWA, 33 U.S.C. § 1311.
