Case summary

Cease and Desist Administrative Order. EPA Region 6 issued an Administrative Complaint under our authority pursuant to the Clean Water Act (CWA)to Smith and Smith Petroleum Company located in Avant, OK. The Respondent’s oil field facility was a point source which discharged a pollutant to waters of the United States. The facility was inspected by the EPA on April 21, 2011. During the inspection, the EPA observed that a tank battery facility had discharged oil field brine and produced wastewater to a tributary of Tucker Creek. A Cease and Desist Administrative Order was issued to Smith and Smith Petroleum Company on May 3, 2011. The Administrative Complaint was issued in response to violations of Section 301 of the CWA, 33 U.S.C. § 1311.
