Case summary

T J Jordan Towing, Inc. was inspected on September 14, 2006. A Field Citation was issued requiring compliance within 30 days and assessed a penalty. The facility did not respond to that field citation or to subsequent enforcement actions. On August 17, 2010, the Final Default Judgment and Permanent Injunction was signed ordering T Jordon Towing to pay a civil penalty for multiple violations of RCRA Subtitle I, underground storage tank regulations, and come into compliance within 28 days. The Judge granted a Motion Seeking Contempt Sanctions Against Defendant which was filed on January 28, 2011. The Order Holding Defendant In Civil Contempt and Imposing Sanctions permitted EPA to temporarily disable the tanks and/or dispensers by any practicable means. The Order also stated that the U.S. Marshall accompany EPA and ensure that the Order was carried out. The dispensers at the facility were disabled by locking the nozzles in the cradles on March 22, 2011. This allows the defendant access to the tanks for the purpose of repairs but prevents him from dispensing fuel. It also allows a quick and efficient method to verify that the locks remain in place on the dispensers. Company has filed for bankruptcy. New referral on 10/22/13 and filed on 10/28/13.
