VIOLATIONS: ENVIRONMENTAL PROTECTION AGENCY (EPA) REGULATIONS REQUIRE THE OWNER OR OPERATOR OF AN INJECTION WELL TO PLUG A WELL WITHIN ONE YEAR AFTER TERMINATION OF INJECTION OPERATIONS. THE BUREAU OF INDIAN AFFAIRS TERMINATED THE LEASE FOR ONE OF RESPONDENTS INJECTION WELLS, EFFECTIVE MARCH 9, 2007. RESONDENT VIOLATED EPA REGULATIONS BY NOT PLUGGING THE WELL WITHIN ONE YEAR AFTER LEASE TERMINATION. REMEDY: PLUG ONE INJECTION WELL.
