Case summary

Agrifos Fertilizer LLC, Pasadena, Texas. As part of the National Phosphate Mineral Initiative, an investigation was initiated at Agrifos in the Spring of 2008 regarding compliance of EPCRA, CERCLA, and CAA. During the course of the investigation it was discoverd that Agrifos had failed to file reports to TRI and to the State of Texas, pursuant to EPCRA & 313, for the coincidental manufacture of numerous toxic metal compounds from 2004 through 2007. Additional violations were added for CERCLA & 103 and CAA & 112(r). EPA and Agrifos entered into negotiations and have resolved the settlement with a penalty. The Consent Agreement and Final Order was filed with the Regional Hearing Clerk on 09/27/2010.
