Schering Plough Animal Health is in violation of FIFRA Section 12(a)(1)(E), 7 U.S.C.& 136j(a)(1)(A) which states it is unlawful for any person to sell or distribute pesticide or device that is misbranded. On 4/13/2010,Schering Plough Animal Health submitted a Notice of Arrival(NOA)to EPA Region 6 for the unregistered pesticide, Deltamethrin. On 4/26/2010 For Cause inspection done by LDAF revealed this product, Deltamethrin, was being imported to be re-formulated into the unregistered product, Sputop, and exported to Belgium and did not meet the export labeling requirements as set forth in 40 C.F.R. 168.65.
