This Civil Referral was settled for a one-time Corps approved mitigation bank payment of $900,000 and best management practice level restoration of three onsite streams. Respondent began construction of two residential developments, Benders Landing in Spring, TX, and Lake Windcrest in Magnolia, TX in 2006. 53 acres of wetlands and 2.5 miles of streams were illegally filled. The streams filled were either intermittent streams which flowed seasonally or were perennial. They all flowed into a traditionally navigable water (West Fork, San Jacinto River, Spring Creek). Estimated cost of Stream stabilization is $250,000.
