EPA v. Arkansas Egg Company, Inc.

Case summary

EPA referred Arkansas Egg Company, Inc. to DOJ on January 28, 2010, for violations of the Clean Water Act. Arkansas Egg had violated the Clean Water Act and its ADEQ permits by not operating and maintaining its waste retention ponds which resulted in discharges of pollutants to waters of the U.S. The referral included the Appletown, Blair Farms and Summers Farm facilities. Since the time EPA referred this case, Arkansas Egg has closed both the Appletown and Blair Farms. The Summers facility has converted from a liquid manure to a dry manure and cage free facility. The injunctive relief sought at the Summers Farm facility includes properly closing the retention control structure and finding another means of disposal of their egg washwater. The lagoon closure must be completed by December 31, 2013. Arkansas Egg in accordance with Arkansas Department of Environmental Quality (ADEQ) approval has also begun processing its egg washwater in a septic tank and then into a leach field. ADEQ was our partner in the action against Arkansas Egg.
