Case summary

Violation: Unauthorized brine discharge to a waters of the US. The Respondent's tank battery facility was a point source discharge of a pollutant to waters of the US. The facility was inspected on December 9, 2008, and an it was observed by the EPA that oil field was being discharged from the facility to the Deep Fork River and the adjacent wetlands. Relief: An Administrative Order (AO) is being issued to the Respondent requiring the Respondent to 1) stop the discharge; 2) remove all brine and contaminated soils from the flow path located between the facility and the adjacent wetlands of Deep Fork River; 3) Remove all brine from the wetlands area, located at Latitude 35° 30.185’ North and Longitude 95° 55.403’ West, which was discharged from the facility on or about November 20, 2008; 4) Reconstruct secondary containment to prevent seepage of brine to the wetlands area and Deep Fork River; 5) Install electric sump pump to keep containment dry; 6) Install overflow detection equipment at tank battery to prevent additional discharges; and 7) Within thirty (30) days of the effective date of this Order, Respondent shall provide written certification to EPA Region 6, that these requirements have been completed.
