Case summary

On July 11, 2013, DOJ filed a Notice of Lodging of a Consent Decree (CD) negotiated with James Ballengee, Lisbon Processing, LLC, and Lisbon Refinery, JV, LLC. The State of Louisiana through LDEQ is a Plaintiff-Intervenor on the CD, which settles CAA, RCRA, and CWA violations from the 2006-2009 operations at the Lisbons petroleum storage facility located in Lisbon, Claiborne Parish, Louisiana. The defendant will pay a civil penalty of $65,000 to the United States with $32,500 of that amount directed to the Oil Spill Liability Trust Fund. An additional $65,000 will be paid to LDEQ. The CD also requires the defendants to remove several roll-off boxes that have been at the facility since the mid-1990s, to settle outstanding orders from LDEQ, and to install ground water monitoring wells to replace existing wells destroyed in 2006 when the plaintiffs demolished the refinery located at the site.
