Case summary
On May 30, 2017, a Notice of Lodging was filed with the court for a Consent Decree (CD) between EPA and Alon USA, LP under EPA's Clean Air Act, National Petroleum Refinery Initiative. This initiative has resulted in significant emission reductions of nitrogen oxides (NOX), sulfur dioxide (SO2), benzene, volatile organic compounds, and particulates through CDs with companies whose refineries comprise over 90 percent of the nation's petroleum refining capacity. The State of Texas declined to participate in this settlement. The injunctive relief in the CD requires the company to install controls that when fully implemented are estimated to reduce emissions of SO2, and NOX, by approximately 2455 and 477 tons per year respectively. The estimated cost of the injunctive relief under the CD is approximately $108 million. Under the terms of the settlement, Alon will pay a $456,250 penalty. The CD also requires the company to implement a Supplemental Environmental Project valued at $1.5 million that will result in a further reduction of about 47-64 tons per year of NOX through the retrofit of 4 heaters on-site with Next Generation-Ultra Low NOX burners.
