Respondent is operating a concrete batch plant, which is an industrial activity , that failed to have an NPDES storm water permit for storm water discharges to the City of Santa Fe's MS4, thence to the Santa Fe River. EPA inspected the facility on Feb. 22, 2006, and found the facility to be without permit coverage since they took over the facility from Coppola Concrete on September 6, 2005. EPA is ordering the facility to obtain NPDES permit coverage and come into compliance with their permit.
