EPA v. Central Texas Marketplace Apartments, LLC (TXU010488)
Final Order With Penalty
Case summary
CENTRAL TEXAS MARKETPLACE APARTMENTS, LLC (TXU010488/TXR15H713): A storm water compliance inspection was conducted at the site of the Central Texas Marketplace Apartments in Waco, TX, by the EPA on September 29, 2004, to evaluate compliance with the Storm Water Construction General Permit. The Respondent had developed a Storm Water Pollution Prevention Plan (SWP3) and had applied for permit coverage under the Texas Construction General Permit. However, there were deficiencies noted during the inspection. Those deficiencies, specifically, were no Notice of Intent (NOI) posted, the SWP3 did not state who was responsible for control measures, the construction start date and major grading dates were not included, and the SWP3 was not signed by either the owner or the operator. Because the Respondent met the criteria for the Expedited Settlement Offer (ESO), one was mailed on March 22, 2005. Penalty was paid timely. Consent Agreement Final Order was signed by Respondent and routed for Agency signature and 30 public notice.
