Case summary

Respondent's facility exploded and had a large fire on July 28, 2005, requiring emergency response by the city of Fort Worth, the State of Texas (TCEQ) and EPA (Scott Harris, On Scene Coordinator for EPA). Discharges resulting from this fire amounted to 2-3 million gallons of contaminated water, most of which was captured in storm drainage ditches, but some of which made it further down the ditch that goes to the West Fork of the Trinity River. Respondent also captured wastewater in fractionaction tanks at two locations and is partially treating it before discharging to the city of Fort Worth's sanitary system, but in so doing, the first frac tank discharge violated zinc local limits of the pretreatment program. Respondent is being ordered to cease any non-authorized discharges and to comply with the pretreatment program and following the directions given by the On Scene Coordinator in rememediating the contaminated water.
