Case summary

Larkin Energy Incorporated Class 1 Administrative Complaint VIOLATIONS: The Respondent's tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Little River, located in the Northwest Quarter of Section 36, Township 6 North, Range 7 East, Seminole County, Oklahoma. The discharge of brine was documented during a April 22, 2004 inspection. RELIEF: The Class I Complaint proposes up to a $32,500 penalty for the violations. Currently the lease is shut down and the BLM is directing the site clean-up efforts. The site clean-up consists of the following: ceasing all discharges from the facility; removing a pipe from the facility?s berm wall; rebuilding the secondary containment; remediation and restoration of the contaiminated soil. Because of these site clean-up efforts the EPA is willing to reduce the proposed penalty and settle this case for $6000 which is proposed in the attached CAFO.
