Case summary
EAGLE CONTRACTING, LP (TXR10QR54): A storm water compliance inspection was conducted on September 9, 2003, at the construction site of the City of Plainview wastewater treatment plant. At commencement of activities at the site, the City was exempt by from the requirement of applying for construction permit coverage under Phase I regulations. Although the site was less than five acres, Eagle Contracting, LP, applied for permit coverage under the EPA 1998 Construction General Permit. The March 5, 2003, TCEQ Construction General Permit granted automatic coverage for small sites if a construction site notice was signed and posted and a Storm Water Pollution Prevention Plan (SWPPP) was developed. Eagle Contracting, LP, did not post the required notice, effectively rendering the company without permit coverage for at least six months. They had also failed to install the necessary controls to minimize pollutants from being discharged from the site. Eagle Contracting, LP, failed to establish final stabilization prior to leaving the site. An administrative order was drafted to address these violations.
