VIOLATIONS: The Respondent' tank truck was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Lagoon Creek. The Respondent is located at 602 North Bristow Avenue, Drumright, Oklahoma. RELIEF: The Class I Complaint proposes up to a $32,500 penalty for the violations. However, the Respondent and the EPA entered into a settlement agreement in which the Respondent agreed to perform a SEP to a near by tank battery facility which is owned and operated by the Respondent. The SEP includes: removing contaminants; removing a hose which poses a potential for a contaminated discharge; reconstructing secondary containment; providing electricity to the facility to provide power for a sump pump; soil analysis; and soil remediation and restoration. The final completion date for the SEP is July 15, 2004. An EPA inspection will determine if the Respondent had fully cooperated with the SEP and a penalty of $850 will be offered to the Respondent in the CAFO.
