Case summary

A storm water compliance inspection was conducted by EPA on September 5, 2003, to evaluate compliance with the Texas Construction General Permit for Construction Activities. It was determined at that time, that because construction was done in phases of less than 5 acres, submission of a Notice of Intent (NOI) was not required. However, development of a Storm Water Pollution Prevention Plan (SWPPP) was required. GPP Arlington, LLC, had prepared a SWPPP but it was inadequate and what they did have was not being properly implemented. An administrative order was drafted to address the violations.
