Case summary

In response to numerous citizen complaints, EPA and the Oklahoma Department of Agriculture, Food, and Forestry (ODAFF) inspected this facility six times in 2001 and two times in 2002. These inspections revealed that the facility did not have adequate storage capacity to contain process-generated wastewater and stormwater runoff. Also, the number of acres used for land application of wastewater was not adequate for the amount of effluent generated by the facility. Because of inadequate wastewater storage capacity and insufficient land application acreage, the facility violated its permit by land applying wastewater at rates that far exceeded agronomic rates. Runoff of effluent from land application areas directly discharged into adjacent creeks and streams, in violation of the Clean Water Act and the EPA Region 6 CAFO general permit. This Order imposes a penalty for the violations specified above.
