VIOLATIONS: The Respondent' tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Little Cane Creek, located in the Northwest Quarter of Section 13, Township 14 North, Range 14 East, Okmulgee County, Oklahoma. The discharge of brine was documented during a December 3, 2003 inspection. RELIEF: The Order specifies that the Respondent should also take steps to cease all discharges of pollutants and to neutralize the brine contaminated area north and west of the tank battery by applying soil amendments to neutralize the sodium chloride. Additionally, the Order asks the Respondent to consider: (1) constructing secondary containment; (2) installing an automatically activated sump pump; and (3) repair or replace equipment that is leaking. A follow-up inspection will determine the extent of compliance with the Order.
