Case summary
VIOLATIONS: The Respondent' tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary to Council Creek, located in the Northeast Quarter of Section 19, Township 19 North, Range 5 East, Payne County, Oklahoma. The discharge of brine was documented during a May 21, 2003 inspection. RELIEF: The Class I Complaint proposes up to a $27,500 penalty for the violations. However, the Respondent and EPA entered into a settlement agreement in which the Respondent agreed to perform extensive relief to the facility. Relief included: terminating the operations of the facility; removing contaminants; closing out a pit; and soil remediation and restoration. The final deadline for completion of the settlement work was November 8, 2003. The final EPA inspection determined that the Respondent had cooperated fully with the settlement agreement and a penalty of $500 was offered for settlement.
