Case summary

An inspection for storm water compliance was conducted by EPA on November 15, 2003. During the inspection it was noted that the Storm Water Pollution Prevention Plan (SWPPP) was inadequate in that it did not identify all potential sources of pollution, did not identify all operators, the site description was incomplete, there was no sequence of events, there was no copy of the permit6, the SWPPP was not signed and certified, there was no construction sign posted, and control measures were not properly maintained. It was determined that this facility did qualify for the Expedited Settlement Offcer and was issued an order to come into compliance. A Consent Agreement and Final Order for penalties was also issued and is awaiting the 30-day public notice period and final signatures
