EPA v. Casillas Petroleum Corporation

Unilateral Administrative Order Without Adjudication

Case summary

Casillas Petroleum Corporation VIOLATIONS: The Respondent, tank battery facility was a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Six Shooter Creek, located in the Southwest Quarter of Section 09, Township 12 North, Range 11 East, Okfuskee County, Oklahoma. The discharge of brine was documented during a September 18, 2003 inspection. RELIEF: The Order specifies that the Respondent should also take steps to cease all discharges of pollutants and to neutralize the brine contaminated area south of the tank battery by applying soil amendments to neutralize the sodium chloride. Additionally, the Order asks the Respondent to consider: (1) removing a pipe from the outside of the berm wall; (2) constructing adequate secondary containment; (3) installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; (4) repair or replace all leaking equipment; and (5) update the lease sign. A follow-up inspection will determine the extent of compliance with the Order.
