Case summary

VIOLATION: 1) Respondent did not make timely applications for stormwater general permit coverage, permit coverage for its activities at the facility, and was not covered by a NPDES permit at the relevant times for relevant activities. 2) On April 18, 2003, the facility was inspected by an EPA Storm Water Inspector and was found to be in violation of its NPDES permit. Relief: Within thirty (30) days: 1) The Respondent shall make a complete and correct application for permit coverage, submit to EPA a copy of the permit application, and a copy of the confirmation of coverage; 2) The Respondent shall take whatever corrective action is necessary to correct the deficiencies and eliminate and prevent recurrence of the cited violations and submit a written report detailing the specific actions taken; and 3) If complete correction of the cited violations is not possible within thirty days, the Respondent shall submit a comprehensive written plan for the elimination of the violations within the shortest possible time.
