VIOLATIONS: Respondent owns or operates a housing construction site located in the Franklin Hills Unit I subdivision in El Paso, TX, and as such, is an operator subject to regulations of the Clean Water Act (CWA). On April 18, 2003, EPA conducted a compliance inspection of the facility. As a result, Respondent had not obtained NPDES permit coverage for its storm water discharges and failed to develop and implement a SWPPP, as required by the NPDES. RELIEF: (a) within 30 days take corrective action; (b) within 30 days submit written report on corrective actions, (c) if not possible to correct the violation within 30 days, submit comprehensive plan to do so.
