VIOLATIONS: The Respondent' tank battery facility was a point source discharge of polluntants, specifically brine, to the receiving waters of Dog Thresher Creek, located in the Northeast Quarter of Section 21, Township 24, North, Range 11 East, Osage County, Oklahoma. The discharge of brine was documented during a September 2, 2003 inspection. RELIEF: The Order specifies that the Respondent should also take steps to cease all discharges of pollutants and to neutralize the brine contaminated area south of the tank battery by applying soil amendments to neutralize the sodium chloride. Additionally, the Order asks the REspondent to consider: (1) constructing addequate secondary containment; and (2) installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; (3) repair or replace leaking equipment; and (4) up-date the existing lease sign to reflect Patina Oklahoma Corporation as the current operator. A follow-up inspection will determine the extent of compliance with the Order.
