Case summary
VIOLATIONS: Two of the Respondent's tank batteries were a point source discharge of pollutants, specifically brine, to the receiving waters of a tributary of Negro Creek. The discharge violations occurred at two Butkin facilities, located in the Northwest (Butkin Broadbent lease) and Southeast (Butkin South Velma Permian Unit) Quarters of Section 1, Township 2 South, Range 5 West, Stephens County, Oklahoma. Th discharge of brine was docvumented during an May 14, 2003, inspection of both facilities. RELIEF: The Class I Complaint proposes up to a $27,500 penatly for the violations. However, the Respondent and EPA entered into a settlement agreement in which the Respondent agreed to perform extensive relief at three facilities in Stephens County, Ok. Relief included: removing contaminants; rebuilding secondary containment; de-constructing a large reserve pit; soil analysis, remediation and restoration; and obtaining and implementing SPCC plans where appropriate. The final deadline for completion of the settlement work is November 1, 2003. A final EPA inspection will determine the extent to which the Respondent implemented the settlement and an appropriate penalty will be determined.
