Kimsey Land & Cattle, LLC (OKG010144), Guymon, Oklahoma: At all times relevent to this Order, Respondent, E.R. Kimsey owned or operated a feed operation, located at Guymon, in Texas County, Oklahoma, with a mailing address of Route 3 Box 32, Guymon, Oklahoma 73942. The facility is an �animal feeding operation� where animals are stabled or confined, and fed or maintained at the facility for a total of 45 days or more in any 12 month period; and, crops, vegetation forage growth, or post-harvest residues are not sustained in the normal growing season over any portion of the lot or facility. The facility stables 500 cattle for a total of 45 days or more in any 12 month period. Therefore, this facility constitutes a medium �Concentrated Animal Feeding Operation� (CAFO). On January 14, 2003, the Oklahoma Department of Agriculture, Food, and Forestry conducted an on-site inspection of this facility, on behalf of EPA. The inspection revealed that this facility's primary AWRS contained erosion to the interior wall and contained small trees. Physical characteristics unsatisfactory to the permit�s requirements. This Order requires the facility to submit to EPA updated records to support solid and liquid wastes are properly handled and liquid retention facilities are maintained at a level to retain a 25-year, 24-hour rainfall event.
