Case summary
EPA inspected Alan Ritchey Diary and found numerous permit violations at this facility. EPA inspectors observed ongoing unauthorized discharges of process-generated wastewater from the silage storage area into Brown Creek. EPA inspectors also documented the unauthorized discharge of storm water runoff from (1) the manure and stall bedding disposal area, (2) the carcass disposal pits, (3) the hopital area, and (4) an outdoor cattle lot. To address these violations, EPA issued an Administrative Order to the facility. EPA's Order required the facility to immediately take all necessary measures to prevent any discharge of pollutants to waters of the U.S. from any part of the facility. These measures include, but are not limited to (1) containing storm water runoff, (2) properly disposing of dead animals to prevent contamination of surface water and, (3) providing documentation to EPA indicating that this facility has adequate capacity to contain all process-generated waste water and runoff from a 25-year, 24-hour storm event. The Order also required the facility to initiate a weekly visual inspection program to determine if any discharges are occuring. This visual inspection program shall continue until the facility fully complies with the conditions of its permit. The Order required the facility to set up a meeting with EPA to address the violations specified in EPA's Order.
