Case summary

A compliance evaluation inspection was conducted January 15, 2003 at the Barrington Hills Estates in Argyle to ascertain compliance with the General Permit for Storm Water Discharges at Construction Activities. It was determined that Kerr-Pearson Development, Ltd., had violated the permit in that some of the BMPs at the site were inadequate to keep sediment on site, and the Storm Water Pollution Prevention Plan (SWPPP) was inadequate in some areas. An administrative order was drafted to address these violations. On 7/15/03 the Consent Agreement (signed by Kerr-Pearson Development, Inc.) was routed for final Region 6 signature and issuance. The payment check was sent with the signed CAFO
