Case summary
EPA inspected this facility and found that the facility does not have stormwater runoff containement structures. The facility directly discharges stormwater runoff into the Rio Ruidoso which flows through the middle of this facility. This is a violation of the Clean Water Act. EPA issued an Administrative Order to this facility requiring the facility to take all necessary measures to prevent any discharge of pollutants to waters of the U.S. The Order also required the facility to initiate a weekly visual inspection program to determine if any discharges are occurring. This visual inspection program shall continue until the facility receives an NPDES permit and complies with the conditios of its permit. The Order required the facility to arrange a meeting with EPA to address the violations specified in the Order.
