Case summary

Respondent is a metal finisher with Clean Water Act NPDES pretreatment violations. They are an industrial user and categorical industry for the City of Terrell. Samples taken by City of Terrell showed discharges to the collection system of up to 2200 mg/L Arsenic. EPA issued Administrative Order CWA-06-2002-1087 to Respondent to cease discharges. This Order is a schedule Order allowing them to start operations under conditions of no process wastewater discharges to the city's collection system. Process Water will be collected and disposed elsewhere (Permafix) and/or evaporated. The Order also requires compliance with the NPDES storm water general permit. The Order puts Respondent on permanent quarterly reporting of compliance with NPDES pretreatment requirements. Respondent's Environmental Manager has been arrested by EPA Special Agents.
