Unilateral Administrative Order Without Adjudication

Case summary

Respondent has been receiving and burying about ten to thirteen million gallons of food bi-product oils since the mid 1980's (e.g., from potatoe chip mfg, pecan pie mfg, etc.). This landfilling/land application per 40 CFR 122.26(b)(14)(v) and requires an NPDES storm water permit under the Clean Water Act. Respondent was previously Ordered to obtain a permit and comply with that permit. Respondent failed to timely apply for the permit and has failed to comply with terms of the permit in that Respondent never developed or implemented a storm water pollution prevention plan. This Order restates the Order to comply with the NPDES storm water program as well as add monthly status reporting requirements and require the reporting of sample results. This Order requires Respondent to provide a schedule and description of activities in the remediation of this facility, including providing copies of any Resource Conservation and Recovery Act landfill closure reports (Respondent is under a RCRA Order by the State of Texas).
